Spektrografy Terms of Use

1. Purpose

These Terms of Use ("ToU") govern access to and use of the Spektrografy online service (https://spektrografy.com), published by Vincent Blot, sole trader (entrepreneur individuel, micro-enterprise regime) trading under the commercial name Baggero (SIRET 107 556 896 00010), in France.

Spektrografy is one of the products / tools published under the Baggero commercial name. Full legal notices are on the Legal notices page.

2. Description of the service

Spektrografy lets you create audio-reactive animated visuals from audio and image files you upload, via an online studio (the "Studio"), and export videos in digital format.

Export rendering is performed on the publisher's servers. Processing times may vary depending on load and project duration.

3. Account creation

You must provide accurate information when registering and accept these ToU. You are responsible for keeping your login credentials confidential.

4. Permitted use

You agree to:

- use the service in compliance with applicable laws; - not infringe third-party rights (in particular copyright and related rights on imported audio, images, and logos); - not attempt to circumvent technical or commercial limitations (quotas, resolutions, storage).

You represent that you have the necessary rights to import and export the content you upload to the Studio.

5. Intellectual property and user content

You retain all intellectual property rights in the content you create and the files you import (audio, images, logos, exported videos).

Spektrografy claims no ownership over user creations. The publisher acquires no commercial rights over works produced through the service.

For the sole purpose of providing the service (storage, processing, rendering, export, download availability), you grant Spektrografy a non-exclusive, limited, revocable, royalty-free licence to technically process this content.

### Spektrografy brand and assets

The Spektrografy brand, logo, interface, code, system presets provided by the publisher, and other distinctive signs of the service remain the exclusive property of the publisher (or their respective owners). Any unauthorised reproduction, imitation, or use is prohibited without prior written permission.

6. Free plan, watermark, and quotas

The free plan may include: one free 720p export (one-time trial) at a defined resolution, a storage cap for imported files, and a watermark ("Made with Spektrografy" or equivalent) on exported videos.

7. User feedback (comments and suggestions)

You may voluntarily submit bug reports, suggestions, or reviews via the form provided in the Studio. This data is processed in accordance with the privacy policy.

By submitting comments, suggestions, or ideas, you grant the publisher a worldwide, non-exclusive, perpetual, irrevocable, royalty-free licence to use, reproduce, modify, adapt, and implement that feedback without compensation and without any obligation to credit you.

8. Content reports and notices (DMCA / intellectual property)

If you believe content hosted through Spektrografy infringes your copyright or other intellectual property rights, you may send a notice to contact@baggero.com (recommended subject: "DMCA / IP Notice"), including in particular:

- your identity and contact details; - a description of the protected work and the alleged infringement; - the URL or information identifying the content at issue; - a good-faith statement and, where applicable, the elements required under applicable law (including the DMCA for U.S. rights holders).

The publisher may remove or restrict access to the reported content and, where appropriate, suspend the account concerned, without prejudice to legal remedies.

9. Promotions and contests

Spektrografy does not currently run contests, sweepstakes, or promotional games. Any promotion codes (discounts on exports or subscriptions) are governed by the Terms of Sale and Stripe; they are not contests.

10. Availability

The service is provided "as is". The publisher strives for continuous availability but does not guarantee uninterrupted access (maintenance, technical incidents, export queues).

11. Liability

You are solely responsible for the content you import, the exports you produce, and any public distribution.

The publisher's liability is limited to proven direct damages, within the limits permitted by applicable law. The publisher cannot be held liable for infringement of third-party rights resulting from use of content for which you do not hold the rights.

12. Suspension and termination

You may stop using the service at any time. The publisher may suspend or terminate an account in case of violation of these ToU or the law.

13. Governing law

These ToU are governed by French law. Any dispute falls under the jurisdiction of the courts competent for the publisher's registered office, unless mandatory law provides otherwise.
