Spektrografy Terms of Sale

Terms of Sale for Spektrografy: export pricing, payment, right of withdrawal, and digital delivery.

1. Purpose

These Terms of Sale ("ToS") apply to per-export video purchases and subscriptions offered on Spektrografy (https://spektrografy.com), published by Vincent Blot, sole trader (entrepreneur individuel, micro-enterprise regime) trading under the commercial name Baggero (SIRET 107 556 896 00010), for consumers and professionals using the service.

2. Products and pricing

Prices are shown in euros on the pricing page, in Studio Settings, and at checkout. The publisher benefits from the French VAT franchise (franchise en base, article 293 B CGI): VAT does not apply; displayed amounts are the total price payable. Indicative prices (subject to change):

The prices in force are those displayed on the site at the time of purchase.

3. Order and payment

The order is confirmed after payment via Stripe (card and methods offered by Stripe). Spektrografy does not store card numbers; processing is handled by Stripe (PCI-DSS certified).

Before any payment, you must accept these ToS and the privacy policy. A summary (resolution, price, or subscription plan) is shown before confirmation.

Promotion codes may be entered before payment (per-export or Pro subscriptions). Validity and discount amount or duration are managed by Stripe and displayed before payment. These codes are commercial discounts; they are not contests, sweepstakes, or promotional games. Spektrografy does not currently run such games.

There is no free trial of the Pro subscription: the trial offer is limited to one free HD (720p) export (one-time) on the free plan, with watermark, as described in the table above.

For subscriptions, renewal is automatic (monthly or annual depending on the plan) until cancellation via the Stripe customer portal accessible from Studio Settings ("Manage subscription"), subject to options enabled by the publisher in Stripe.

4. Delivery

The exported video file is provided in digital format (MP4) in the Studio "Exports" area, for direct download, once rendering is complete.

Availability depends on project duration and service load. No fixed deadline is guaranteed.

5. Right of withdrawal

Under French Consumer Code articles L221-18 et seq., consumers generally have a 14-day period to withdraw from a distance contract without giving a reason.

### 5.1 Digital content supplied immediately (exports and Pro access)

For digital content (exported video files) and digital services (Pro subscription with immediate Studio access), the right of withdrawal does not apply when, before payment, the consumer has:

1. given express prior consent for performance to begin before the end of the 14-day period; and 2. expressly waived the right of withdrawal (separate checkbox before payment),

in accordance with article L221-28 of the French Consumer Code.

In that case, payment immediately starts the export render and/or activates the subscription: no withdrawal refund is due for that order.

### 5.2 Exercising the right when it applies

If the right of withdrawal applies (for example no valid waiver), the consumer must send a clear request to contact@baggero.com within 14 days of concluding the contract, including the order or subscription reference. Any refund is made via the same payment method within legal time limits.

Cancelling a Pro subscription for future periods (end of billing period) via the Stripe customer portal is not a withdrawal.

6. Warranties and refunds

The publisher undertakes to provide a file matching the chosen parameters (resolution, frame rate), subject to the rendering engine's technical limits.

In case of a proven defect attributable to the service (corrupt export, render failure not due to incompatible user content), the publisher may offer a new export or a refund after review.

Refunds, where applicable, are made via the same payment method, within legal time limits.

7. Subscriptions — cancellation

You may cancel your Pro subscription via the Stripe customer portal. Cancellation takes effect at the end of the current billing period (month or year depending on the plan), unless otherwise stated at subscription.

- Pro monthly: billed and renewed each month. - Pro annual: billed and renewed once per year; access covers 12 consecutive months from subscription or renewal date.

No pro-rata refund is due for the period already started, unless mandatory law requires otherwise.

### Account deletion

Account deletion (Studio Settings) results in immediate erasure of projects, files, and exports. It is distinct from simple subscription cancellation.

On deletion, any active Pro subscription is cancelled for the next billing date (no further charges). Studio access and data are removed immediately: you do not keep access until the end of the paid period. No refund for the current period is granted, unless mandatory law requires otherwise.

To keep your data while stopping renewal, cancel via the Stripe customer portal ("Manage subscription") without deleting your account.

8. Billing data and records

Transaction records (timestamps, Stripe identifiers, ToS acceptance) are retained in accordance with legal obligations and the privacy policy.

9. Mediation

If a dispute is not resolved with customer service, consumers may use a consumer mediator free of charge under French Consumer Code articles L611-1 et seq.

10. Governing law

These ToS are governed by French law.
